1. SERVICE DESCRIPTION
California Ninja ("Provider") will provide mobile ninja obstacle course services for the Client listed above ("Client"). Services include setup, staffing, and operation of ninja obstacle courses suitable for children ages 5 and up, unless otherwise agreed in writing. Package details to be specified separately or in writing.
2. FEES, PAYMENTS & CHARGES
- Total Event Cost: $3,000
- Deposit: 50% ($1,500)
Event dates are confirmed only once the deposit is received. Events may be subject to cancellation if payment terms are not met.
3. SITE ACCESS & SETUP CONDITIONS
- Provider requires setup access up to 2 hours before event start.
- If actual site conditions differ from what was represented by Client, Provider reserves the right to cancel without refund or charge additional setup fees.
- Setup location must be clean, free of obstacles and debris, and safe for equipment and staff. Any unsafe or inaccessible setup may result in cancellation without refund.
- Sprinkler systems must be turned off at least 24 hours prior to setup.
4. PARTICIPANT WAIVERS & SAFETY
- All participants must sign a California Ninja liability waiver.
- Minors must have waivers signed by a parent/legal guardian.
- No waiver = no participation. No exceptions.
- Client is responsible for assigning volunteers to check waiver status unless Provider is contracted to manage this.
- All participants must wear closed-toe athletic shoes (no Crocs, sandals, cleats, etc.).
5. AGE & SUPERVISION REQUIREMENTS
- Course is suitable for ages 5 and up. Children aged 4 may only participate in a designated session with a 1:3 adult supervision ratio.
6. CANCELLATIONS & RESCHEDULING
- Deposits are non-refundable but transferable for up to two years, provided Client gives at least 30 days notice.
- Cancellations within 30 days of event require full payment of total event cost.
- In case of forecasted inclement weather, rescheduling is allowed up to 24 hours prior to event start (based on availability).
- No refunds or discounts are issued for weather-related shutdowns after setup begins.
- California Ninja staff may cancel or pause activities at any point due to safety concerns, including but not limited to rain, wind, heat, or other hazardous conditions.
7. CLIENT RESPONSIBILITIES & LIABILITY
- Client is responsible for obtaining all necessary permits and approvals for the event.
- Client accepts responsibility for any fines or legal issues arising from lack of permits or unauthorized use of venue.
- California Ninja is not responsible for damage to surfaces such as turf, carpet, gym flooring, etc. during normal setup or use.
8. HEALTH & SAFETY COMPLIANCE
- Client must ensure compliance with all local, state, and federal health and safety guidelines, including those related to COVID-19 or similar public health events.
9. PROVIDER CANCELLATION
- If Provider cancels the event due to reasons unrelated to weather, safety, or access, and a reschedule is not feasible, Client will receive a full refund of any paid deposit.
